Clerk Magistrate Hearings in Massachusetts / Boston Clerk’s Hearings
If the police decide to charge you with a misdemeanor that was committed outside of their presence, they are generally unable to arrest you. Instead, the police have to apply for a complaint at the district or municipal court. You are then entitled to a hearing in front of a clerk magistrate. If the complaint issues against you, the charges will appear on your criminal record and you would have to fight the charges again in front of a judge. If the clerk does not issue the complaint, the case is over, and no charge would appear on your record. The clerk magistrate hearing is a crucial stage. Hiring an attorney and going to the clerk’s hearing prepared is well worth your time. While there is no guarantee of success, you will put yourself in the best possible position if you are represented.
According to a Boston Globe article featuring Attorney Simons, attending a clerk magistrate hearing without an attorney puts people at a huge disadvantage. Going to a magistrate hearing unprepared can lead to criminal charges being issued. If the clerk decides to issue the charges, you will be facing a much bigger battle, likely facing court dates over a lengthy period of time before your case resolves. Prior to the hearing, I will evaluate your case, possibly contact the arresting officer, speak with witnesses, and prepare an argument on your behalf.
What happens at a magistrate hearing?
At the hearing, the arresting officer or a police prosecutor will appear in court to read a report or describe the alleged incident to the clerk magistrate. Witnesses sometimes appear and testify as well. You have the right to testify on your own behalf, although your attorney will advise you of the pros and cons of taking the stand in your case. There is no public record of the hearing. After considering the evidence and hearing oral arguments from the police officer and your attorney, the clerk magistrate will rule on your case. If the clerk finds that there is probable cause to support the charges, then a complaint will issue. If your attorney is able to convince the clerk to dismiss the case, your criminal record will remain clean.

November 14, 2024
Framingham District Court
Client was accused of Operating a Motor Vehicle Without a License. The Framingham Police allegedly pulled Client over for a traffic infraction, and discovered that his license had been expired for more than a year.
Client hired Simons Law Office to defend him on the potential charge. At the clerk magistrate hearing, Attorney Sydney Sheerin represented Client and achieved the best possible outcome: no charge to issue. As a result, the incident will not cause a mark on Client’s criminal record.
Result: Dismissed.
November 8, 2024
Salem District Court
Client was accused of Larceny Over $1200, a felony. The alleged victim claimed that Client stole her dog. With a professional license and otherwise clean record, Client hired Simons Law Office to protect against the potential damage of the false allegation.
Prior to the hearing, we reviewed numerous communications and other documents related to the dog and its transfer. At the hearing, Attorney Joseph Simons produced text messages that made clear that the dog was lawfully transferred to Client and thus, no crime had occurred. The clerk magistrate agreed, and dismissed the complaint.

September 17, 2024
Brockton District Court
Client, a recent high school graduate, was accused of three counts of Shoplifting by Price Tag Tampering. The Abington Police alleged that Client was switching price tags in a local department store in order to purchase expensive items for a lower price. After being confronted with store security and the police, Client admitted to shoplifting. The store also had the thefts on camera.
Seeking to avoid criminal charges, Client hired Simons Law Office to prepare and defend against these allegations. Attorney Joseph Simons persuaded the clerk not to issue the complaint. Instead, the clerk magistrate agreed to dismiss the case completely, as long as Client stays out of trouble for three months. Client’s clean record remains intact.

November 15, 2023
Newburyport District Court
Client, a mother of a teenager, was accused of the charge of Keeper of a Disorderly House by the Newbury Police. Client’s teenaged child had a few people over for a get together. Unbeknownst to the parents, an invitation went out over social media and a large group of teenagers arrived at the home with alcohol. Soon after, and before Client and her husband could do anything, the police arrived due to a noise complaint. They applied for charges against Client and her husband.
Client hired Simons Law Office to protect her otherwise clean record. This morning, at the hearing, Attorney Bill Bougioukas convinced the clerk not to issue the complaint. The clerk magistrate agreed and determined that there was no probable cause to issue the complaint. As a result, our client’s record remains clean.

Client, a 54-year-old woman, was accused of Larceny Under $1200 after allegedly stealing over $500 from a grocery store.
Client hired Simons Law Office. Attorney Chris Auriemma represented Client at the magistrate hearing and convinced the clerk to dismiss the charge. As a result, it will not appear on Client’s record.

Natick District Court
Client, a 59-year-old man with no criminal record, was accused of assault and battery after the Natick Police accused him of assaulting a loss prevention officer at a grocery store.
Client hired Simons Law Office to defend against the criminal allegation. In advance of the hearing, Attorney Joseph Simons contacted the officer involved in order to gather additional information, and prepared for the hearing. Taunton District Court
Client, a young mother and cosmetology student, was accused of two counts of Shoplifting by Asportation Over $250 and two counts of Conspiracy after allegedly being caught – on camera – shoplifting over $1,000 worth of items from two different stores on two different occasions. The Seekonk Police filed an application for criminal complaint and Client was summoned for a clerk magistrate hearing.
Client hired Simons Law Office to try to preserve her otherwise clean record. Attorney Joseph Simons represented her at the hearing and convinced the clerk not to issue the charges. Instead, as long as Client stays out of trouble for six months, the case will be dismissed, and no entry will appear on her record.

Client, a college student, was accused of Threat to Commit a Crime. The Northeastern University Police alleged that Client was “acting violent” and threatened a fellow student.

Attorney Attarchi represented Client at the magistrate hearing and convinced the clerk not to issue the complaint. Peabody District Court
Client, a high school student, was accused of Shoplifting by Concealing Merchandise and Shoplifting by Asportation. The Peabody Police accused Client after he and his friends were allegedly observed stealing from multiple stores at the North Shore Mall.
Client’s family hired Simons Law Office to try to prevent this case from becoming a roadblock for Client as he is applying for colleges and has yet to begin his career. Attorney Sara Attarchi represented Client at the hearing and persuaded the magistrate to dismiss the application for complaint. Client’s criminal record stays clean.

Salem District Court
Client, a 33-year-old woman, was accused of Possession of a Firearm Without FID Card. Salem Police allege that when they performed a well-being check on Client, she willingly let officers into her home and showed them her unlicensed firearm. Client did not have a license to carry or a firearm identification card, and therefore it was illegal for her to possess the gun.
Client hired Simons Law Office to defend against the allegation, despite the overwhelming evidence against her. Attorney Daniel Griffith prepared, represented Client at the clerk magistrate hearing, and miraculously prevailed. The clerk agreed to dismiss the complaint and as a result, the allegation will not appear on Client’s criminal record.

February 3, 2022
Framingham District Court
Client, a business owner, was accused of violating an abuse prevention order. Holliston Police alleged that Client had sent several text messages to an ex-girlfriend in violation of an active restraining order.
Client hired Simons Law Office. The hearing spanned two dates. At the first hearing, Attorney Joseph Simons explained that our firm had issued a number of subpoenas to demonstrate that the alleged texts had been sent via a third-party website and the numbers had been “spoofed.” As a result, the clerk magistrate gave police additional time – over a month – to gather information to tie Client to the purported texts. At the second hearing, the police reported that no further information had been collected. The clerk magistrate decided that there was insufficient evidence tying Client to the messages, and therefore, the application for complaint was denied.
Result: Dismissed.

Roxbury Division
Boston Municipal Court
Client, a 33-year-old man, was accused of Larceny from a Building. Boston Police alleged that Client had broken into an apartment complex and then into a specific apartment, stealing a PlayStation 5, Xbox, games, jewelry, and a firearm.
Client’s family hired Simons Law Office to defend Client against these serious allegations. Leading up to the hearing, Attorney Doug Ryan investigated the facts, interviewed witnesses, and came up with a plan of action. At the hearing, which included three witnesses, Attorney Ryan persuaded the clerk magistrate that there was not enough evidence to find probable cause that Client committed the crimes alleged. The clerk magistrate agreed; the complaint was dismissed and will never appear on Client’s record.

Somerville District Court
Client, a 26-year-old woman, was accused of one count of Animal Cruelty after a bystander called police to report that she locked her dog in the car on a very cold evening. The dog was allegedly shivering and yelping in a crate in the car, and according to police, the temperature was below freezing.
Client hired Simons Law Office. Attorney Sara Attarchi represented Client at the magistrate hearing and convinced the clerk magistrate not to issue the charge. If Client stays out of trouble for 6 months, the case will be dismissed prior to arraignment. As a result, Client is never officially charged with the crime and her record remains clean.

Client, a 64-year-old man, was accused of Impersonation of a Police Officer, after allegedly going to a bar in a police-like uniform and knife, and making a statement about potentially needing to arrest someone.
Client hired Simons Law Office. Attorney Simons represented Client at a clerk magistrate hearing, where he demonstrated that Client’s actions were an anomaly from his usual behavior, and that the conduct did not amount to probable cause and dismissed the application for complaint.

Uxbridge District Court
Client, a recently divorced man, was accused of Disorderly Conduct, Disturbing the Peace, and two counts of Witness Intimidation.
Client hired Simons Law Office. Attorney Simons represented Client at a clerk magistrate hearing, where he demonstrated that Client’s actions were the result of Client’s depression and having just learned that his wife of 23 years wanted a divorce.
The clerk found probable cause but agreed not to issue he complaint. If Client pays a fine of $200 and stays out of trouble for a year, the cases will both be dismissed and never appear on his criminal record.

Woburn District Court
Client, a former special police officer and constable, was accused of carrying a firearm while intoxicated, after his friends reported to the police that he was drunk and they were concerned because he had his gun with him.
Client hired Attorney Joseph Simons, who persuaded the clerk to hold the case open for a period of three months. If client stays out of trouble, no charge will issue.
Result: Dismissed.

Client, a videographer, was accused of Threatening a Business, per G.L. c. 271, § 39(a), after allegedly leaving threatening voicemails on a business’s answering machine. Police claimed to have tracked down Client through his phone number on the caller ID and alleged that Client had made a number of similar threats to other businesses and people.
Client hired Simons Law Office, and Attorney Simons was able to persuade the clerk magistrate not to issue the charge. The clerk agreed to hold the case open for a year and if he stays out of trouble, the case will be dismissed without ever appearing on his record.

Client, a 63-year-old grandmother, was accused of shoplifting after allegedly stealing bracelets from Kohl’s. Client hired Simons Law Office, and Attorney Attarchi convinced the clerk magistrate to hold the case open and not issue the charge. As a result, Client was never charged with the crime.

Client, a high school rising senior, was accused of Assault and Battery with a Dangerous weapon. Police claimed that Client threw a mostly full soda bottle at another person, hitting that person in the head. As a result, Client was facing a potential felony charge.
Client’s parents hired Simons Law Office. Attorney Simons researched the alleged victim, and the incident, and uncovered evidence that suggested the assault never happened. At the clerk magistrate hearing, Attorney Simons convinced the magistrate that there was not enough evidence to find probable cause. The clerk agreed, and dismissed the case.

Client, a high school junior, was accused of Defacing Property and Threat to Commit Crime (x2) after allegedly writing a threat to kill all of the Indian girls in her grade with a sharpie on the school bathroom wall.
Client’s family hired Simons Law Office to help protect her freedom and future. Attorney Simons represented Client during a police investigation, which lead to a clerk magistrate hearing. At the hearing, Attorney Simons convinced the clerk not to charge Client. Client, a 56-year-old woman, was accused of Breaking and Entering and Larceny. The alleged victim, her brother, applied for charges after Client went into the home that he shared with their mother, and disposed of the mother’s belongings. At the hearing, Attorney Simons demonstrated that the alleged victim did not have any proof that Client entered the home without permission, nor that she took any property of his. As a result, the complaint was denied, and Client maintains her clean record.

Client, a 25-year-old analyst, was accused of shoplifting at Sephora. With no prior record, Client was concerned about the impact of a conviction. Client, a 39-year-old single mother, was accused of Assault and Battery with a Dangerous Weapon, after allegedly hitting her ex-boyfriend with her vehicle. Client, a 74-year old man, was accused of Violating a Restraining Order against his neighbor. The alleged violation was a letter from his attorney to the trustees of the parties’ condominium association. Client hired Attorney Simons, who demonstrated to the clerk magistrate that the communication, not even directed to the alleged victim, was covered under a “litigation privilege,” and thus, does not constitute a violation of the restraining order. As a result, the complaint was not issued.

Client, a professional from India, was accused of Unlicensed Operation of a Motor Vehicle and No Inspection Sticker. Client, who was here on visa and could not afford a criminal charge on his record, hired Simons Law Office to represent him at the hearing. Client, a 22-year-old man, was accused of Possession with Intent to Distribute Class D (Marijuana), Possession in Motor Vehicle of Open Container of Marijuana, and a civil Motor Vehicle Lights Violation. Police pulled over Client’s friend, who was borrowing Client’s car. They allegedly found over four ounces of marijuana, including baggies and a scale. Client hired Attorney Joseph B Simons, who uncovered several problems with the police “investigation,” including a warrantless search without probable cause. Attorney Simons persuaded the magistrate to dismiss the complaint. As a result, the charges never appear on Client’s record.

Client, an Albanian man, was accused of Assault and Battery on his former friend. His friend accused Client of hitting him during a ride in the car, reported it to the police, and applied for a criminal complaint. Client hired Simons Law Office to defend him against the false allegations, which could have disastrous consequences on his immigration status. At the hearing Client’s friend was adamant about having the charges issue against Client. Instead, Attorney Attarchi successfully cross-examined the ex-friend, and convinced the clerk magistrate to dismiss the case. Client, a condo owner, was accused of Assault and Battery after allegedly hitting her neighbor in the face. The dispute arose from an argument over property rights of the shared building. Client, a wife and mother, was accused of Shoplifting $100+ by Asportation after a loss prevention officer observed her stealing items at Wal-Mart. Police filed an application for criminal complaint, and Client was summonsed for a magistrate hearing. Client missed the hearing and charges were issued. Client hired Simons Law Office to protect her from the allegations.
Attorney Attarchi filed a motion to dismiss prior to arraignment, arguing that Client was entitled to a magistrate hearing and requested that Client receive another hearing date. Over the prosecutor’s objection, the judge agreed. The case was dismissed, and then re-filed for another clerk magistrate hearing. At that hearing, Attorney Attarchi persuaded the magistrate to dismiss the case. After all that, Client is never officially charged and her clean record is unmarred.

Client, a young man, was accused of Criminal Harassment against his neighbor, who happened to be a police sergeant. Client’s neighbor accused Client of harassing him and his family on several occasions. Client hired Simons Law Office to defend him. At the hearing, police wanted Client to face charges for his alleged behavior against their brother in arms. However, Attorney Attarchi convinced the clerk magistrate to dismiss the case completely. Client walks away with no charges on his record.

Police alleged that Client walked out of a sporting goods store with several stolen boxes of ammunition, while in possession of two loaded handguns.
Client was summonsed for a magistrate hearing, and hired Simons Law Office. Attorney Simons put in a lot of legwork, contacted the police officers involved, and conduced an independent investigation. Client, a young man with a visa from China, was accused of Assault and Battery on his girlfriend’s ex-boyfriend. In reality, the ex-boyfriend had been stalking Client and his girlfriend and showed up at Client’s apartment looking for trouble. Police showed up, but rather than arresting Client, they issued an application for complaint and Client was summonsed for a magistrate hearing. Client hired Simons Law Office. At the hearing, the ex-boyfriend/alleged victim was also represented by an attorney and was adamant about seeing Client charged. After a contentious hearing, Attorney Simons convinced the clerk magistrate to dismiss the case. As a result, Client maintains his clean record and does not suffer any immigration consequences.

Client, a husband and father of two, was accused of four counts of Assault and Battery against his wife. The wife had just filed for divorce, and also a restraining order. Client suspected that his wife was using the allegations as a tactic to help her in the divorce case and hired Attorney Joseph B Simons to defend his rights. Today at the hearing, Attorney Simons convinced a clerk magistrate not to issue the complaint. Instead, the case is held open for six months. If Client stays out of trouble, the case will be dismissed and he will never have been officially charged with a crime. His criminal record will remain clean, and his immigration visa will not be affected.

Client, a 25-year old pharmacy doctoral candidate, was accused of Malicious Destruction of Property Over $250 (a felony), after allegedly smashing up two vehicles with cinder blocks in the middle of the night with a friend of his. Clients hired Attorney Joseph B Simons, who investigated the case, spoke with the victims, and prepared the case for hearing. Boston Police and Northeastern University Police were involved. Both departments were pushing for the charge to go forward, as officers also accused Client of yelling, swearing and generally being belligerent to them. To make matters worse, Client had a history of alcohol-fueled incidents with campus police. In between the incident and the hearing, Client took the first steps toward confronting his alcohol dependence, and had already paid a stiff penalty by way of a two-year suspension from grad school, just months before graduation. Today, at the hearing, Attorney Simons persuaded the clerk magistrate to hold open the case. As a result, if Client remains out of trouble for one year, the case will be dismissed and never appear on his record.

Client, a 50-year-old cab driver, was accused of Carrying a Firearm without an FID Card and Motor Vehicle Trespassing. The Environmental Police filed an application for criminal complaint against Client for hunting on private land with an expired FID card. Client hired Attorney Joseph B Simons to fight the charges.
